PRIVACY POLICY & DATA PROTOCOL

SAY LESS / NYC (“the Company,” “we,” “us”) maintains a sovereign commitment to the privacy of our visitors and applicants. This Privacy Protocol (“Protocol”) establishes the standards by which we safeguard your digital identity and governs the processing of all personal information within the SAY LESS ecosystem. By engaging with this interface, you irrevocably agree to the terms herein. This Protocol establishes a binding agreement between the user and the Company regarding the handling of sensitive metadata and personal identifiers.

1. DATA CONTROLLER & REGULATORY SCOPE

In strict accordance with the New York SHIELD Act (Stop Hacks and Improve Electronic Data Security Act), we maintain a comprehensive information security program designed to protect "Private Information." This Protocol applies exclusively to this Web site and our hosted services; it does not extend to third-party platforms which may have materially different practices.

2. MANDATORY ADULT AUDIENCE (21+)

SAY LESS / NYC is an exclusive environment for adults.

  • PROHIBITION: We do not direct content to, or knowingly collect data from, individuals under 21 years of age.

  • AGE GATE: By submitting an application, you certify you have reached the Legal Age in the State of New York.

  • INCINERATION: If the system identifies a visitor under the Legal Age, all associated personal information, metadata, and identifiers will be promptly and permanently deleted from our servers.

3. INFORMATION CATEGORIES & COLLECTION ARCHITECTURE

To facilitate entry into the ecosystem and ensure community compatibility, we collect:

  • Legal Identifiers: Full legal name and verified date of birth for identity validation.

  • Secure Contact Points: Encrypted email and mobile numbers.

  • Social & Aesthetic Metadata: Instagram handle and associated social graph data for vetting and membership.

  • Demographic Data: Optional gender identity used strictly for internal community balancing.

4. ENCRYPTION & SECURITY (NY SHIELD ACT COMPLIANCE)

We implement administrative, technical, and physical safeguards that exceed industry standards:

  • Encryption at Rest: All data assets are secured within our Wix High-Security Infrastructure using AES-256 bit hardware-level encryption.

  • Encryption in Transit: All communications are protected via TLS/SSL 1.3 protocols.

  • Zero-Access Architecture: We operate a closed-loop system. Your data is never sold, leased, or monetized to third-party marketing firms or data brokers. Access is restricted to our internal Vetting Committee under strict Non-Disclosure Agreements (NDA).

5. RETENTION & THE "RIGHT TO BE FORGOTTEN"

  • Application Purge: If an application is denied or remains inactive for 90 days, all associated data is automatically scrubbed from our active processing environment.

  • Erasure Request: Members may exercise their right to permanent deletion. Upon a verified request, all digital footprints will be purged within 30 days.

6. PROTOCOL CHANGES & NOTIFICATION

  • We reserve the right to modify this Protocol at any time. Material changes will be communicated via email or a 30-day notice on our home interface. Continued use of the Website after such changes constitutes your acceptance of the revised terms.

7. LIMITATION OF LIABILITY & DISCLOSURE

  • No Warranty: While we utilize data encryption, no system is impenetrable. You acknowledge the inherent risks of digital transmission.

  • Legal Disclosure: We only disclose information if compelled by a valid court order or subpoena from a New York State or Federal authority.

THE SYSTEM RULES: CODE OF CONDUCT

1. SIGNAL OVER NOISE (COMMUNICATION)

  • Quality of Interaction: We value brevity and intent. Harassment, spam, or non-consented persistence is classified as "system noise."

  • Zero Tolerance: Any verified report of predatory, disrespectful, or discriminatory behavior will result in immediate termination of access without the right to appeal.

  • No Commercial Solicitation: This is a space for human connection, not for aggressive networking, service promotion, or commercial solicitation.

2. IDENTITY INTEGRITY (VERIFICATION)

  • Authentic Identity: Your presence within the system must be consistent with your linked Instagram profile. Catfishing or the use of synthetic/manipulated imagery is grounds for immediate expulsion.

  • Physical Safety: IRL (In Real Life) encounters are the sole responsibility of the members. The system assumes no liability for interactions occurring outside the digital infrastructure.

3. THE "ERASURE" MANDATE (INACTIVITY)

  • Active Density: To maintain a dynamic ecosystem, accounts with total inactivity exceeding 60 days will be automatically archived. If you emit no signal, the system assumes your exit.

  • Decide or be Erased: The system constantly purges data from unselected applications to ensure the security of the global database.
